Acceptance of Terms and Conditions

By registering as a member or using the website located at SelectLetings.com the user ("You") agree to these Terms and Conditions.

In the following terms and conditions, the terms "You" or "Your" refers to you the "Customer" or "Advertiser" or "Vendor" or "Property Owner" or “Landlord” and in some cases the "Buyer" or "Purchaser". "We" "us" or "ours" refers to "SelectLettings.com", whichever applies. The "Service" refers to online property advertising purchased by the Customer and provided through the website network of SelectLettings.com

SelectLettings.com has the right to re-design part or the entire website and to reposition advertising and sponsorship accordingly without prior notice.

Accuracy of Information

In no event or circumstance shall SelectLettings.com be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence, arising out of or in connection with the use or performance of this information.

It is your responsibility to verify any information that you may obtain on SelectLettings.com with independent authorities before acting upon it.

It is your responsibility to use suitable anti-virus software on any material that you may download from SelectLettings.com

SelectLettings.com does not warrant the content or accuracy of any material or other information on the website or the credentials of any landlord or tenant.

SelectLettings.com will not be liable for any injury, loss, claim, damages of any kind arising out of or in connection with a Landlord's or tenant’s use of the website.

User account, password and security

If a particular Service requires you to open an account you will be required to complete the registration process by providing certain information and registering a username and password for use with that Service. You are responsible for maintaining the confidentiality of the username and password and also for all activities which take place under your account. You agree to immediately notify us of any unauthorised use of your password or account, or any other breach of security. In no event whatsoever will SelectLettings.com.com be liable for any indirect or consequential loss or damage resulting from the disclosure of your username and/or password. You may not use another person's account at any time, without the express permission of the account holder.

Acceptable use

You acknowledge that all information, text, graphics, logos, photographs, images, moving images, sound, illustrations and other materials (""the Content""), whether posted publicly or transmitted privately, are the sole responsibility of the person from whom such Content originated. We do not control or endorse the Content and cannot guarantee the accuracy, integrity or quality of such Content and you acknowledge that by using the Services you may be exposed to Content that is offensive and/or indecent. SelectLettings.com will not be liable in any way for any Content or for any loss or damage of any kind resulting from the use of any Content transmitted via the Services and you agree to bear all risks associated with the use of any Content, including any reliance on the accuracy or completeness of such Content."

In using the Website/Services you agree not to:

• Use the Services to send junk email, Spam, chain letters, pyramid schemes or any other unsolicited messages, commercial or otherwise.

• Post, publish, distribute or disseminate material or information that is defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful.

• Post, publish, distribute or disseminate material or information that incites discrimination, hate or violence towards any person or group on account of their race, religion, disability, nationality or otherwise.

• Threaten abuse, disrupt, stalk or otherwise violate the legal rights (including rights of privacy and publicity) of others.

• Use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right of any party.

• Make available or upload files that contain a virus, worm, Trojan or corrupt data that may damage the operation of the computer or property of another.

• Collect or store personal information about others, including email addresses.

• Advertise or offer to buy or sell goods or services for any commercial purpose, unless such communication facility specifically allows such messages.

• Impersonate any person or entity for the purpose of misleading others.

• Violate any applicable laws or regulations.

• Use the Website/Services in any manner that could damage, disable, overburden or impair the Website/Services or interfere with any other party's use and enjoyment of the Website/Services.

• Post, publish, distribute or disseminate material or information that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information or confidential information disclosed in the course of employment or under a confidentiality agreement).

• Attempt to gain unauthorised access to any of the Services, other accounts, computer systems or networks connected to the Website/Services through hacking, password mining or any other means.

We have no obligation to monitor the Services but shall be entitled to review materials posted to a communications facility and, at our sole discretion, to remove any material that breaches these Terms and Conditions or is otherwise objectionable.

Consent

By submitting your property details to us for publication you are indicating:

That you are the legal owner of the property with the sole right to sell, or you have legal power of attorney on behalf of the property owner.

That you agree to SelectLettings.com publishing these details for you.

That the details supplied by you are TRUE and ACCURATE and not misleading in any material way.

That on receipt by us of your payment, advertising of your property for rent or to-let (the service) is to commence immediately.

Copyright

In respect of any property details or photographs submitted by you for publication, you confirm that you own full title to such details and/or photographs and you agree to grant a copyright license to SelectLettings.com

Note that you cannot use photographs from estate agent's particulars without their express permission - it is the customer's responsibility to ensure they have copyright over any materials supplied to us for publication on their behalf and you agree to indemnify SelectLettings.com in respect of any claims against us or expenses incurred by us in respect of breach of copyright issues.

Photographs, images, property descriptions and all other content published on this website are copyright of SelectLettings.com and may NOT be copied from this site and reproduced in any other advertisement or marketing, without our written consent. For the sake of clarity - this does not prevent customers from using their own materials elsewhere PROVIDING that such details are not back-sourced from this website.

Transfer of Advertising

Individual property listings are NOT transferable and may not be used for advertising of more than one property or any property other than the property listed for rent or to-let initially without our explicit permission.

Privacy & Security

Your personal details are held on a secure database and any data transmitted on our website is secured using a 256-bit encrypted SSL certificate. Only the details that you wish to be published are made available to our site visitors. We do not pass confidential customer information to other organisations. Your Property Descriptions

All details supplied by owners to us must be a FAIR, HONEST and TRUE representation of the property you are renting/letting out. It's a waste of everybody's time (including yours) if you deliberately provide a misleading description of the property, intentionally or otherwise, so please take some care over the details you submit.

We reserve the right to edit or delete any descriptions which we know or believe to be false or misleading or where there is a potential for misunderstanding. We routinely check all listings and may make amendments to improve presentation, correct spelling, obvious errors. The property description should only provide a factual breakdown of the property features - it should not include 'claims' about the property or terms for renting/letting which are not a matter of fact or which cannot be ascertained and verified by reasonable inspection, or in the case of any legal aspects, confirmed by available documentation.

The factual accuracy of the information supplied for publication on this site, is the responsibility of the advertiser and you agree to indemnify SelectLettings.com against any claims or expenses arising from misleading or inaccurate claims made by you about the property within the advertising published.

Limit of Liability

The maximum liability for any loss arising due to our negligence will be limited to a sum equal to the value of the advertising fee received.

Pricing

The prices shown on this website are subject to VAT at the applicable rate. There are no hidden costs. We reserve the right to amend or change pricing or package service content at any time without notice.

Billing
All on-line ads are paid for on SelectLettings.com. During the registration (for free) you will be required to agree to the terms and conditions, you will then have access to your account area where you will be able to construct and place your property advert on SelectLettings.com.

SelectLettings.com will debit your credit or debit card (when such information has been provided by the client) through RBS Worldpay.

Upon the advert first being placed, a payment for the chosen package for the first 30 days of advertising will be taken, thereafter whilst the advert is active on SelectLettings.com a recurring payment for the chosen package will be taken every 30 days.

You can take your advert offline whenever you wish or when it becomes occupied, this can be done in ‘my account area’ on SelectLettings.com. The next payment will then not be taken.

We DO NOT refund partial monthly fees to accounts.

Refunds

Due the nature of our advertising service no refund of our advertising fees will be made, this is in accordance with the distance selling regulations. Other circumstances may be reviewed and a refund may occasionally be given at the discretion of the management, however, under no circumstances will our liability exceed the value of the advertising fee recieved.

Distance selling regulations
Clause 8(3) of The Consumer Protection (Distance Selling) Regulations 2000 states that the statutory cancellation (cooling-off) period of 7 days for services purchased over the internet, does not apply where performance of that service has already commenced with the customer's agreement.

Our online payment facilities are designed to activate your public advertising automatically and therefore, by making a payment for advertising on this site you signify your agreement to the advertising service commencing IMMEDIATELY and that the standard cooling-off period does not apply as per clause 8(3) of the Regulations.

No refund of our advertising fees will be made for loss of service, temporary or permanent, under any circumstances.

This does not affect your statutory rights as a consumer.

This policy forms part of the User Agreement, and by accepting the User Agreement upon registration you confirm that you have read and understood this policy and agree to be bound by the terms and conditions contained within.

Interruption of Service

SelectLettings.com makes every reasonable effort to ensure that our website facilities are available to internet visitors and customers at all times. However, we do not offer any guaranteed percentage time of availability and accept no financial liability for any interruption in service or temporary loss of some or all website facilities at any time.

On occasion, necessary maintenance or upgrade work requires the site to be taken 'off-line' without notice, but we endeavor to keep downtime to a minimum and in most cases of scheduled maintenance, this normally involves no more than a few minutes.

Our website is hosted in a secure data centre with excellent security, fire and backup measures in place and a very high level of service is anticipated.

Featured Property

If you choose a package which also includes displaying your property as a "Featured Property" on SelectLettings.com website, the point at which your property is displayed and the duration of the displayed period is entirely random.

Virus protection

SelectLettings.com makes every effort to check and test material at all stages of production. You must take your own precautions to ensure that the process which you employ for accessing this website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. It is always wise for you to run an anti-virus program on all material downloaded from the internet.

SelectLettings.com cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from this website on the internet.

Links to external internet websites

Links on Selectlettings.com will lead to other websites which are not under our control. We are not responsible for the content of any linked site. Listing and linking should not be taken as an endorsement of any kind and we accept no liability in respect of the content. We cannot guarantee that these links will work all of the time and have no control over the availability of the linked pages.

Complaints

If you experience any problem using our service, let us know straight away and we will do everything in our power to put things straight. We are justifiably proud of the quality of our website functionality, customer care and support, however on rare occasion’s small bugs or errors can occur, so please contact us if you have a complaint about any aspect of our service to you.

Please quote your property ID in all communications. We aim to respond to all enquiries within 48 hours.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Jurisdiction

Any dispute pertaining to the provision of our service is subject to the laws of England & Wales.

Changes to Terms and Conditions

We reserve the right to change these Terms and Conditions without prior notice to you. If we change the Terms and Conditions, it will be posted to the web site and become effective at the time of posting.

Applicable Law

These terms and conditions shall be governed by and construed in accordance with English law and the parties hereby submit to the non-exclusive jurisdiction of the English courts in respect of any dispute or matter arising out of or connected with these terms and conditions.

If you do not agree to obey these terms and conditions you must stop using the Website immediately.
